WEDDING PHOTOGRAPHY & VIDEOGRAPHY AGREEMENT

Where selected as part of a combined package, videography services are provided by:

Reel Irish Wedding
Operated independently by Derek Lawless
Based in Ireland

This Agreement forms a legally binding contract between:

Andrew Collins Photography (“the Photographer”)
Reel Irish Wedding (“the Videographer”), where applicable
and The Client(s).

This Agreement is accepted by the Client(s) by:

  1. Confirming agreement via the booking form checkbox; and

  2. Submitting the booking form; and

  3. Paying the €400 booking fee.

Upon completion of the above, a legally binding contract is formed.

1. Structure of Services (Combined Packages)

1.1 Andrew Collins Photography and Reel Irish Wedding operate as separate and independent businesses.

1.2 When a combined Photography & Videography package is booked:

  • Photography services are provided solely by Andrew Collins Photography.

  • Videography services are provided solely by Reel Irish Wedding

1.3 Each provider is independently responsible for their own:

  • Equipment

  • Creative process

  • Editing

  • Delivery

  • Insurance

  • Professional conduct

1.4 Nothing in this Agreement shall constitute a partnership or joint venture between Andrew Collins Photography and Reel Irish Wedding.

1.5 Liability for photography services rests solely with Andrew Collins Photography.

1.6 Liability for videography services rests solely with Reel Irish Wedding.

2. Booking & Reservation

2.1 A non-refundable booking fee of €400 is required to secure the wedding date.

2.2 No wedding date is reserved until:

  • This Agreement is signed, and

  • The booking fee has cleared.

2.3 The booking fee secures exclusive availability for the agreed date and compensates for loss of alternative bookings.

2.4 The remaining balance is due no later than the wedding date unless otherwise agreed in writing.

2.5 Editing and post-production (photography and/or videography) will not begin and no delivery of Photographs / Video will be made until full payment has been received.

3. Cancellation & Rescheduling

3.1 The booking fee is strictly non-refundable under all circumstances.

3.2 If the Client cancels:

  • More than 6 months before the Event: booking fee retained.

  • Between 6 months and 30 days before the Event: 50% of total fee payable.

  • Within 30 days of the Event: 100% of total fee payable.

3.3 Cancellation must be made in writing.

3.4 Postponements are treated as cancellations unless otherwise agreed in writing.

3.5 Rescheduling is treated as cancellation unless both Photographer and Videographer (where booked) are available for the new date.

3.6 If Andrew Collins Photography must cancel due to serious illness, injury, death, or force majeure, liability is limited to refund of photography monies paid.

3.7 If Reel Irish Wedding must cancel due to serious illness, injury, death, or force majeure, liability is limited to refund of videography monies paid. 

3.8 Refund of monies paid constitutes full and final settlement of any claim.

3.9 Neither provider shall be liable for the performance or failure of the other.

4. Force Majeure

The Photographer and/or Videographer are not liable for failure to perform due to circumstances beyond reasonable control including but not limited to:

  • Severe weather

  • Government restrictions

  • Venue closure

  • Traffic incidents

  • Pandemic-related restrictions

  • Religious or venue limitations

5. Artistic Style & Creative Control

5.1 The Client confirms they are familiar with the Photographer’s and Videographer’s portfolios and styles.

5.2 Wedding photography and videography are artistic services and results are subjective. Dissatisfaction based solely on personal taste or subjective preference does not constitute breach of contract.

5.3 Each provider retains full artistic and editorial discretion over:

  • Composition

  • Lighting

  • Posing

  • Editing style

  • Colour grading

  • Image/video selection

  • Final delivery

5.4 RAW files and unedited footage are not provided.

5.5 Advanced retouching (body reshaping, face swaps, person removal, etc.) is not included.

5.6 Re-edits outside the standard style may incur additional fees.

6. Coverage Limitations

6.1 Coverage is dependent upon:

  • Timeliness of bridal preparations

  • Cooperation of bridal party and guests

  • Venue restrictions

  • Lighting conditions

  • Weather conditions

6.2 Delays caused by the Client may result in reduced coverage.

6.3 Neither Photographer nor Videographer is responsible for missed moments due to schedule overruns or guest interference.

6.4 No specific image, video clip, or moment is guaranteed.

6.5 Estimated image or video duration quantities are not guaranteed.

6A. Client Cooperation, Timeline & Event Management

6A.1 The Client acknowledges that wedding photography and videography are time-sensitive services delivered in a live, uncontrolled environment. The quality and completeness of coverage are directly dependent upon the cooperation of the Client, bridal party, family members, guests, venue staff and other suppliers.

6A.2 The Client agrees to:

  • Ensure the wedding day proceeds broadly in accordance with the agreed timeline.

  • Ensure the Photographer and Videographer are provided sufficient time at each stage of the day.

  • Ensure all key individuals required for formal photographs or video are present when requested.

  • Appoint a designated representative (e.g., Best Man, Bridesmaid or family member) to assist in gathering individuals for group photographs.

  • Inform the Photographer and Videographer in advance of any special moments, surprises, performances or schedule changes.

  • Ensure guests, content creators and other suppliers do not obstruct, distract, or interfere with professional coverage.

6A.3 The Photographer and Videographer shall not be held responsible for missed moments, reduced coverage, or incomplete group photographs where this arises due to:

  • Delays in hair/makeup or preparations,

  • Late ceremony start,

  • Extended receiving lines,

  • Overrunning meals or speeches,

  • Guests leaving early,

  • Individuals refusing to participate,

  • Guest interference or obstruction,

  • Venue restrictions or time limitations,

  • Poor lighting conditions,

  • Weather conditions,

  • Schedule changes not communicated in advance.

6A.4 If delays caused by the Client or third parties reduce the effective coverage time, the Photographer and/or Videographer shall not be liable for any reduction in deliverables, image count, video duration, or missed moments.

6A.5 The Client acknowledges that no specific photograph, pose, individual guest, or video clip is guaranteed, even where requested in advance.

6A.6 Where professional advice or direction is declined by the Client, the Photographer and Videographer cannot be held responsible for the resulting outcome.

6A.7 The Client understands that wedding days are dynamic events and that absolute coverage of every guest, detail, or interaction is not possible.

6A.8 The Photographer and Videographer reserve the right to cease coverage temporarily if faced with unsafe, aggressive, intoxicated or disruptive behaviour. In such circumstances, no refund shall be due.

7. Timing of Events

7.1 Speeches occurring in full blocks (before or after dinner, or during the drinks reception) can be covered. Partial speeches occurring between dinner courses may not be fully covered.

7.2 First dance commencing after 10:00pm incurs €150 per additional hour (photography and/or videography).

7.3 Spontaneous events outside the agreed schedule may not be captured.

8. Ceremony & Venue Restrictions

8.1 The Photographer and Videographer cannot override instructions from celebrants, venues, or officials.

8.2 Certain religious ceremony elements may not be photographed or filmed.

8.3 Physical obstructions and guest interference are outside professional control.

9. Drone / UAV Services

9.1 Drone operations are subject to:

  • Irish Aviation Authority regulations

  • Weather conditions

  • Airspace permissions

  • Signal Interference

  • Wildlife protection laws

  • Venue permission

  • Safety assessment on the day

9.2 Drone flights are not guaranteed.

9.3 The operator’s safety decision is final.

9.4 Drone footage is supplementary and not guaranteed.

10. Exclusivity

10.1 The Photographer shall be the sole professional photographer retained.

10.2 The Videographer shall be the sole professional videographer retained.

10.3 Guests and content creators may take photos or videos provided they do not interfere.

11. Meals & Breaks

11.1 The Photographer and Videographer must be provided with a hot meal and seated break during dinner service.

11.2 Coverage pauses during meal breaks.

12. Delivery & Storage

12.1 Photography delivery timeframe: approximately 10–16 weeks (longer during peak season).

12.2 Videography delivery timeframe: approximately 10–16 weeks (longer during peak season).

12.3 Albums: approx. 6 weeks after final image selection.

12.4 Once album layouts are reviewed by the client and are approved for print, no changes may be made.

12.5 Final photos / footage files are stored for a reasonable period but indefinite storage is not guaranteed.

12.6 RAW photos / footage are stored for 6 months. After this period, files may be permanently deleted without notice.

12.7 Clients are responsible for backing up delivered files.

13. Copyright & Usage

13.1 Photography copyright remains with Andrew Collins Photography.

13.2 Videography copyright remains with Reel Irish Wedding.

13.3 Clients receive personal-use licence only.

13.4 The Photographer and Videographer may use content for:

  • Website

  • Social media

  • Marketing

  • Portfolio

  • Competitions

Opt-out must be requested in writing before the wedding date.

14. Data Protection & GDPR

14.1 Andrew Collins Photography and, where applicable, Reel Irish Wedding, process personal data in accordance with the General Data Protection Regulation (EU) 2016/679 and the Irish Data Protection Act 2018.

14.2 Personal data collected may include, but is not limited to:

  • Names

  • Addresses

  • Email addresses

  • Telephone numbers

  • Wedding date and venue details

  • Payment information

  • Photographic and video imagery

14.3 Personal data is collected for the purposes of:

  • Performing this contract

  • Communicating with the Client

  • Delivering photography and/or videography services

  • Processing payments

  • Maintaining business records

  • Marketing (where lawful and appropriate)

14.4 The legal basis for processing personal data is:

  • Contractual necessity

  • Legitimate business interests

  • Legal obligations

  • Consent (where applicable)

14.5 Photographic and video content may be stored securely on encrypted devices and secure cloud storage providers. Where cloud storage providers are located outside the EU, they will be compliant with appropriate data protection safeguards.

14.6 Personal data will not be sold or shared with third parties except where necessary to perform the contract (e.g., album printers, cloud gallery providers, payment processors).

14.7 The Client has the right to:

  • Request access to their personal data

  • Request correction of inaccurate data

  • Request deletion of personal data (subject to legal and contractual obligations)

  • Lodge a complaint with the Irish Data Protection Commission

14.8 The Client acknowledges that wedding photographs and videos may include images of guests. It is the Client’s responsibility to inform guests that photography and videography will take place.

14.9 The Photographer and Videographer may retain images and video files for archival, legal, and portfolio purposes.

14.10 Certain data (including invoices and financial records) may be retained for the legally required accounting period under Irish law.

15. Limitation of Liability

15.1 In the unlikely event of total photographic failure, liability of Andrew Collins Photography is limited strictly to the amount paid for photography services.

15.2 In the unlikely event of total videography failure, liability of Reel Irish Wedding is limited strictly to the amount paid for videography services.

15.3 No liability for:

  • Indirect losses

  • Emotional distress

  • Third-party supplier failure

  • Guest interference

  • Equipment failure beyond reasonable control

15.4 Total liability shall not exceed the respective contract value paid.

16. Substitution

In the unlikely event of illness or emergency:

  • Andrew Collins Photography may appoint a suitably qualified substitute photographer.

  • Reel Irish Wedding may appoint a suitably qualified substitute videographer.

17. Complaints

17.1 Complaints must be submitted in writing within 14 days of delivery.

17.2 The relevant provider must be given a reasonable opportunity to rectify any proven technical error.

18. Chargeback & Payment Disputes

18.1 By signing this Agreement, the Client acknowledges:

  • The booking fee is non-refundable.

  • Cancellation charges are contractually agreed.

  • The services are bespoke and date-specific.

18.2 The Client agrees not to initiate chargeback proceedings without first contacting the relevant provider in writing to seek resolution.

19. Governing Law

19.1 This Agreement is governed by the laws of Ireland.

19.2 Any disputes shall be subject to the exclusive jurisdiction of the Irish Courts.

CLIENT DECLARATION

I/We confirm:

  • We understand Andrew Collins Photography and Reel Irish Wedding operate independently.

  • We understand liability is separate.

  • We understand the cancellation structure.

  • We understand artistic control rests with each provider.

  • We understand this forms a legally binding contract.
